and use of the aiasistant.com website, services, and platform (collectively, the "Service"),
operated by INTELLECT COMM TECHNOLOGIES LTD ("we," "us," or "our").
By creating an account, accessing, or using our Service, you agree to be bound by these
Terms. If you do not agree, please do not use the Service.
1. Description of Service
aiasistant.com is an Artificial Intelligence Software as a Service (SaaS) platform providing
tools for text generation, image creation, code generation, custom chatbots, voiceovers,
video creation, and POS/Stripe payment integrations. The Service operates on a
subscription and/or credit-based system.
2. User Accounts
2.1. Eligibility: You must be at least 18 years old to use the Service. By agreeing to these
Terms, you represent and warrant that you are of legal age.
2.2. Account Security: You are responsible for safeguarding your account credentials. You
agree to notify us immediately of any unauthorized use of your account. We are not liable
for any loss or damage arising from your failure to protect your login information.
3. Payments, Subscriptions, and Credits
3.1. Billing: We use Stripe, a third-party payment processor, to bill you for subscriptions and
credit purchases. By providing a payment method, you authorize us (via Stripe) to charge
applicable fees.
3.2. Subscriptions: Subscription plans are billed in advance on a recurring basis (e.g.,
monthly or annually). You may cancel your subscription at any time through your account
settings, but the cancellation will take effect at the end of the current billing cycle.
3.3. Credits: Certain features require the consumption of digital credits. Credits have no
real-world currency value, are non-transferable, and may expire depending on your specific
plan terms.
3.4. Refunds: Due to the nature of AI generation and the immediate consumption of server
resources, all payments and credit purchases are generally non-refundable unless required
by applicable consumer law.
4. Content Ownership and Intellectual Property
4.1. Your Input: You retain all ownership rights to the prompts, text, images, and documents
("Input") you submit to the Service. You grant us a limited, worldwide license to use your
Input solely for the purpose of providing and maintaining the Service.
4.2. Generated Output: Subject to your compliance with these Terms, you retain the rights to
the content generated by the AI models ("Output") based on your Input. You may use the
Output for commercial and non-commercial purposes.
4.3. Similarity of Output: Due to the nature of machine learning, Output may not be unique
across users. The Service may generate the same or similar Output for other users. You do
not hold exclusive rights to Output generated for others.
5. Acceptable Use Policy (AUP)
You agree not to use the Service to:
- Generate, promote, or distribute illegal content, including CSAM (Child Sexual Abuse
Material), hate speech, harassment, or violence.
- Infringe upon the intellectual property rights, privacy, or copyrights of others.
- Develop malware, phishing attempts, or engage in malicious hacking.
- Attempt to reverse engineer, scrape, or bypass the security or rate limits of the platform.
- Generate spam, misleading information, or engage in fraudulent activities.
Violation of this policy will result in immediate account termination without a refund.
6. Disclaimer of Warranties regarding AI
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." WE MAKE NO GUARANTEES
REGARDING THE ACCURACY, RELIABILITY, OR SUITABILITY OF THE GENERATED
OUTPUT. Artificial Intelligence can produce unpredictable, inaccurate, or "hallucinated"
results. You are solely responsible for reviewing and verifying all Output before relying on
or publishing it.
7. Third-Party Services
Our platform integrates with third-party APIs (e.g., OpenAI, Anthropic, ElevenLabs, Stripe).
Your use of the Service is also subject to the terms and limitations imposed by these third-
party providers. We are not responsible for the uptime, performance, or content policies of
these third parties.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, INTELLECT COMM TECHNOLOGIES LTD
SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR
PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED
DIRECTLY OR INDIRECTLY, ARISING FROM YOUR USE OF THE SERVICE OR THE
GENERATED OUTPUT.
9. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of England
and Wales. Any disputes arising out of or in connection with these Terms shall be subject to
the exclusive jurisdiction of the courts of England and Wales.
10. Changes to the Terms
We reserve the right to modify these Terms at any time. We will notify you of material
changes by posting the updated Terms on the website or via email. Your continued use of
the Service after such changes constitutes acceptance of the new Terms.
